Paul Harte
Principal Lawyer
Paul Harte is the founder of Harte Law. He is recognized as one of Canada’s leading medical malpractice trial lawyers. He is Certified Specialist in both Health Law and Civil Litigation. Over the course of his more than 30 year career, Paul has successfully tried or settled more than $100 million in medical negligence claims.
Paul has played a key role in numerous high-profile matters, including the Commission of Inquiry into the Blood Supply in Canada, the Wilson Hepatitis B Class Action, the Stephen James Pain Clinic Class Action, the ReproMed Class Action, and the Testaguzza Acupuncture Class Action. He was lead counsel in D.P. v. Wagg, a landmark Ontario Court of Appeal decision on the admissibility of Crown evidence in civil proceedings.
A past president of the Ontario Trial Lawyers Association (OTLA) and former chair of its Ethics Committee, Paul is a frequent speaker at legal conferences throughout Canada and the United States. He is also an outspoken advocate for patients harmed by medical error and is often featured in national media. His work has been profiled in the Canadian Bar Association’s National magazine and he appeared on the cover of Canadian Lawyer Magazine.

Maria Damiano
Senior Lawyer
Maria Damiano has been a dedicated member of Harte Law for over 20 years. Her practice is exclusively focused on medical malpractice, where she advocates for individuals and families who have suffered serious medical harm across Canada. She is consistently recognized by Lexpert and Best Lawyers as a leading practitioner in the field of medical negligence.
Maria is a Past President of the Ontario Trial Lawyers Association (OTLA) and currently serves as Treasurer and Council Member of the Medico-Legal Society of Toronto. Maria is also an active contributor to legal scholarship, having published articles on medical malpractice in the Advocates’ Quarterly and the Annual Review of Civil Litigation.
A sought-after speaker, Maria regularly presents on medical malpractice to both legal and medical audiences. She is also an instructor in the Trial Advocacy program at Osgoode Hall Law School, where she helps train the next generation of courtroom lawyers.

Giuseppe (Joe) Michelucci
Senior Lawyer
Joe Michelucci has been with Harte Law for over 25 years, focusing exclusively on medical malpractice and representing individuals across Canada who have suffered serious medical harm. He joined the firm after graduating from Osgoode Hall Law School in 1996, and has built a career dedicated to complex and high-impact litigation.
Joe has developed particular expertise in class actions and mass torts, serving in a leadership role in several landmark cases. He played a central role in the firm’s mass tort actions against disgraced physicians Errol Wai-Ping and Richard Austin, helping to achieve justice for hundreds of affected women. He also has extensive experience in obstetrics and gynecology malpractice cases, and has successfully prosecuted numerous claims involving birth injuries and women’s health.
Outside of his legal practice, Joe is active in his community. He is the former Treasurer and a past Board Member of the Central Eglinton Children’s Centre, a non-profit child care centre in his neighbourhood.
Joe is a member of both the Ontario Trial Lawyers Association (OTLA) and the Canadian Italian Advocates Organization.

Joshua Harte
Lawyer
Joshua Harte is the newest member of the Harte Law team. He graduated from Western Law School in 2023 and was called to the Ontario Bar in 2024. He also holds an undergraduate degree in Commerce from the University of Guelph.
Joshua’s practice is focused exclusively on medical malpractice, where he is committed to advocating for patients who have suffered serious harm due to medical negligence. He is a proud member of the Ontario Trial Lawyers Association (OTLA) and brings energy, dedication, and a strong academic foundation to the firm’s work.

Ruth Ann Luciano
Nursing Consultant
Ruth Ann Luciano has been an integral part of Harte Law for over 20 years, serving as the firm’s nursing consultant. She earned her nursing diploma from George Brown College in 1991 and has extensive experience caring for both adult and pediatric patients in surgical, medical, and palliative care settings—across hospitals and community-based environments.
Ruth Ann began consulting on medical files with Harte Law in 1995, and joined the firm full-time in 2002. She is a member of the Institute of Law Clerks of Ontario and the Ontario Trial Lawyers Association (OTLA). Her clinical expertise and deep understanding of patient care continue to be invaluable in the assessment and development of complex medical malpractice cases.

Heather White
Senior Law Clerk
Heather White is a senior law clerk at Harte Law with over 15 years of experience assisting victims of medical negligence. She holds a diploma in Law and Security Administration from Sir Sandford Fleming College.
Before joining Harte Law in 2010, Heather spent a decade working as a legal assistant in personal injury defence, giving her valuable insight into both sides of the litigation process. Her knowledge, attention to detail, and dedication make her a key member of the firm’s medical malpractice team.

Joanna Amstein
Office Manager
Joanna Amstein is the Office Manager at Harte Law and a key member of our administrative team. Joanna plays a vital role in supporting both our legal team and the clients we serve. Known as our in-house troubleshooter, she handles a wide range of responsibilities with efficiency and care.
